How do you sue a contractor that you go to church with that wont finish the job but has all the $ for job?
This Contractor has a business that is registered with the BBB but I can not get anyone from the BBB to call me back and we have paid for all but 3000 of the job and he only has done framing and drywall some painting and some mudding the ceiling and the rest of the project is not finished and he will not return our calls or answer our messages. He has a key to our house and now my husband is leaving in the military and I do not know what to do it has been since last october since he has touched the job. How do I pursue this I do not have a lot of money for an attorney and I am stuck with a second mortgage because I can not refinance because he took all the money and did not finish the job.

You should sue them with a 2×4. But you should contact the Attorney General or try the local News Station to put some pressure on him.

Contact an elder from the church and let them know of the situation. He will probably call you both in to discuss the situation and try to solve it. Take another church brother/sister with you as a witness. If you are both christians you should try to solve it this way before you take any legal action.

NEWBEE1 gave you some good advice. Call the Attorney General or one of your Television News stations about the matter. The Tv News folks can put him in the spot light and he will HAVE to finish the job to your satisfaction or else he will loose business because of the negative attention.
As a Christian however – and I don’t know of any churches that practice the New Testament’s advice – you are to talk to the man – and if he wont hear you or listen to reason, you get a fellow Christian to come and witness every word. If he still wont hear you, you take it before the Church.
The Church should decide on matters between the brothers and sisters – and should respect the Church’s ruling. Its never done, because few people respect the church, or its own fellow members. The Apostle Paul chewed people out about that and tried to point out that brothers and sisters should not be going to a worldly court – but judge righteous judgment because Christians (true ones) will one day judge angels. if they cant judge civil matters between each other, how will they ever judge righteous judgment.
Anyway – thats my two cents worth,

You should havce held back more money. Your state may have an agency that licenses contractors and may even have a fund to deal with situations like this. You can also try filing a criminal charge since he took your money without compensation.
You can also try a consumer help agency in your state or a consumer help program on TV or radio in your area.
Without knowing what state you’re in, I can’t help too much more.

You should let BBB know you need them to fulfill their mandate or you will go to the press.
You will need to threaten the person with going to the press, TV and the community. Also, document your actions as proof.
Finallyy, many lawyers work on contengency. Which means they dont get paid until you have been succesful in recovering your money.
By the way, you need to do this for yourself and for the other potential victims in the future.
